Legal Question in Insurance Law in New York
Are victims of Superstorm Sandy in NYS able to collect under a homeowners policy for loss of use claims due solely to flood damages? I have been in temporary housing since the storm while I complete rebuilding. The insurance company feels that the event is not covered therefore my loss of use claim is invalid.

Unfortunately, with most policies of insurance, especially the disreputable ones, we have a recurring scenario of bad faith disclaimers having no relation to policy coverage articles. You require an attorney to review your policy and disclaimer; review court decisions regarding the interpretation of those provisions and attempt to negotiate a settlement in your favor if there is any possibility.
