Legal Question in Intellectual Property in New York

Copyright: Chaffee Amendment, HR 3754

My nonprofit organization produces free audio compilations of magazine articles for blind subscribers, recorded in a ''specialized format'' (4-track tapes). Thus we need not seek permission from copyright holders of the published written material we reproduce (Chaffee Amendment, H.R. 3754). However, we plan to make our audio magazine downloadable from the Web in MP3 format. If we assign passwords to our blind subscribers and/or require them to click a box stating they are blind, does that satisfy Chaffee and allow us to avoid seeking permission from copyright holders?

You can't safely base your company's actions on a LawGuru opinion because we're not giving legal advice here. What you'll need is a legal opinion so you can always say you relied on it. They aren't free because attorneys have to cover their bills, like malpractice insurance.
