Legal Question in Intellectual Property in New York

Copyright Infringement/Fair Use

Does the displaying of an instruction diagram owned by a third party for purposes of a constructing a "how-to" manual on the Internet constitute "fair use"? If this in-fact constitutes infringement, what possible avenues are there to overcome the infringement, if any?
