Legal Question in Intellectual Property in New York

Is there any form of legal organization (LLC, INC etc.) under which an individual can operate a website, such that the individual would be completely immune from any legal action resulting from the website?

Can a website and its owners be sued for a copyright infringement without first being notified and given the opportunity to remove the offending material?

As a Franchise Attorney I can this about your copyright infringement question. You can be sued for copyright infringement anytime you infringe. There is no requirement that the copyright owner first notify the infringing party and give them an opportunity to remove the infringed work.
