Mixing to products on market to make a new product

I want to mix two products on the market now to make an original product. What steps should I take to ensure this mix is legal or can be protected by a patent or copyright the name of it. I know it needs to be ''nonobvious'' but how do I determine if it is non obvious or not. Thank you
