Legal Question in Intellectual Property in New York

Photo sent to me via cell phone

If someone sends me a semi-naked photo of themselves using their cell to my email address, is the picture now mine. If I was to share the photo or post it on the internet, would that be a problem? Do I open myself up to anything?

The photographer would be the owner of the image unless he/she assigned it to a third party. If you post the photo without the consent of the photographer you'd be violating their copyright; without the consent of the subject of the photo, possibly a violation of the NY Civil Rights law or other actions.
