Legal Question in Intellectual Property in New York

Using a registered trademark

I want to advertise my new game for

iPhones and blackberries by making a

tshirt that says ''buy the XYZ app for

your iPhone or Blackerry''. I am well

aware that these a registered

trademarks and that I need permission

to use them . Which part/dept of the

companies do I address?

To sell the iphone version you have to go through the iphone store I believe -- so check the licensing agreement for listing/selling on that site as it will likely answer your question. As for the blackberry, check the licensing agreement for the DK you used to develop the software -- again, it may answer your question. If no DK kit you may try their web site to see if RIM provides an answer. If not, you'll need to contact either companies' licensing department. However, given the complexity and risks associated with licensing IP/TMs you may desire to be represented by an attorney familiar with software and TM licensing. Best of luck with your project.
