Legal Question in Intellectual Property in New York

I represent a production company. Our website is looking into featuring songs on our website. In most cases this would be mutually beneficial, as my company would get to use the song and the band would gain exposure. Can this be done strictly between us and the band (or whoever owns the rights to the particular song)? Or are we required by law to go through a licensing company?

You can try to go through individual rights holders. However the rights holders may have exclusive arrangements with the licensing organizations, such as ASCAP and BMI.
