Legal Question in Intellectual Property in New York

SAT questions for a class to teach

If i start a private SAT prep class. I can just buy SAT books for each student and use the their questions right?

Copyright attaches to non-governmental publications, including the SAT questions and the commercially available outlines and question/answer books. You may need to license the use of the materials (that probably isn't difficult, but you'll need an attorney to help you do it so that you get the best possible deal out of it).

Be aware that the price of not licensing the materials properly can be a copyright infringement lawsuit. Copyright infringement remedies have Big Teeth. They can be punitively expensive, especially for a small business/individual.

If you are tutoring for the exam, using published books and reviewing and explaining the answers is a proper use as long as you do not claim the work as your own ( the Q and A not your explainations or tips.)
