Legal Question in Intellectual Property in New York
I am trying to start an Internet business. The business would feature music samples of musical artists, like iTunes. I do not plan to pay for the samples. Is this legal? As long as I have permission of the artist or record company aren't I o.k.? Given the nature of the business I am trying to start what type of lawyer would be best to hire to set up the necessary argreements/contracts I would need?

Using the works of others without paying for them is called copyright infringement UNLESS you have the WRITTEN permission of the copyright holder to use the material.
Yes, you need a lawyer to help you set up your business. Specifically, you should look for someone who combines intellectual property and business law. I'll give you the first step on that search and let you know that I combine those two areas in my practice. Yes, this can all be easily done by phone, email, SKYPE, and fax.
