Legal Question in Intellectual Property in New York

Virtual Items

I have been selling virtual webkinz items and acccounts on ebay for money. Recently they have banned my ebay account. I created a website to sell these items and they sent me a letter telling me to shut it down. These virtual items are my items arent they? , do they legally have a right to tell me I cannot sell them? These items and accounts can go for some big money. 1 guy sold his World of warcraft account for $10,000.

Re: Virtual Items

I'll add to Mr. Browde's answer that if you are using copyrighted material belonging to another without permission, they, too, may have several actions against you, of which shutting you down is definitely the least.

Re: Virtual Items

If you are using trademarks belonging to another company without permission, they have a number of actions they can take against you. Shutting you down could be the least of them.
