Legal Question in Employment Law in New York

Getting back pay from employer

I recently worked for a start-up company from 1/04-5/04. The company did not do as well as I expected, so I moved on. The company has not paid my final check, in the amount of $1250. It was due to me on 5/25. Since it was a startup, I was paid through personal checks from the owner, so I do not have pay stubs from my tenure. I do happen to have an email from the CFO of the company admitting they owe me the full amount. The work was performed in NY, although the company is based in Indiana. The company is still in business today. Please let me know if you need any additional info and what actions I should take to get the wages owed to me.

Thanks in advance,

Eric

Thank you for your inquiry. This response is for informational purposes only and should not be construed as legal advice.

Contact the New York State Department of Labor - the telephone directory will have the telephone number, or you may be able to contact them through the internet - and explain that you have a claim for back wages that have not been paid, and that you want to file a complaint for the monies owed. Attach a copy of the letter that you have from the company's CFO admitting that they owe you the wages directly to your complaint. The NY State DOL should be able to help you and answer any questions you have.

Thank you again.
