Legal Question in Employment Law in New York
Background Check & Drug Testing
I have been working for a small computer consulting company contracted to the same Fortune 500 client for the past fifteen years. Recently, my employer issued a memo regarding a new policy implementation on background screening and random drug testing. According to the memo, in order to meet its contractual agreement with our client, I am to submit to an immediate urine analysis and to complete a form asking all sorts of personal information including education, health, and criminal convictions for background verification. It's not the fact that I have anything to hide and should not make a big deal of this, but something just sit right with me. 1) Do I have to submit to this treatment after fifteen years of loyal spotless employment? 2) Would there be any recourse for me in the event of my refusal and subsequent termination?

Re: Background Check & Drug Testing
Employers have a lot of leeway in setting hiring and retention standards. Generally, so long as the conditions required to be met are not illegal they will pass muster.
