Legal Question in Employment Law in New York

Building Useage

As a custodian of a school building, is there any law that says that whenever the school is being used for school groups, mostly after hours. Meaning teachers and students, that a custodian must be present. Our union contract does not say anything on this. also our union rep. Its ok aslong as they do not clean up, then they will be doing OUR JOBS. THANK YOU

Must Custodian Be in School Building

I am aware of no law which would compel the presence of a custodian at an "after hours" school function. Such a "requirement" is most often a school "policy" or part of the relevant union contract.

Why do you inquire? In any event, you may want to contact the New York State Department of Education and make that inquiry to them. I believe that they have a web site.

Good luck.
