Legal Question in Employment Law in New York
Compensation Discrimination
I've been with this law firm 11 years and for the first time I feel I'm being ignored or discriminated upon by my supervisor, manager and perhaps HR. I'm currently making about 15% less than the other Analyst in the department who was hired about 8 months ago and is not even trained on the systems we support. After admitting they realize she didn't bring on board the type of experience they thought she had they have been stalling for the last 6 months of me fighting for an increase. I have a background in computers, which help me in my position however, even with the experience, and knowledge in both Telecomm and computers Management does not care enough to at least give me equal compensation. I'm I crazy for sticking around should I risk losing my job by report the firm to the Labor Board regarding the Equal Pay Act? Do I even have a case or should I just continue fighting for equal pay since I'm the only working and have 3 children? HELP!

Re: Compensation Discrimination
The Equal Pay Act is a Federal Law that prohibits pay discrimination between employees on the basis of sex when they perform equal work. New York has a similar law.
You said that you are being discriminated against, but did not say the basis of the discrimination or what facts showed discrimination. What do you mean they have been stalling? Have you asked for a raise? Why is the other person making 15% more than you? Why do you feel this is discriminatory?
I cannot tell you whether you have a case. You simply have not provided enough facts. If you wish to discuss your case in detail, you may contact me at (914) 949-6323. Please be advised that I will NOT be able to tell you whether you should remain at your job or look for another. I can simply tell you the likely legal consequences of your choices.
