Legal Question in Employment Law in New York

I was contacted by the Department of Labor that they have evidence that I was out of the country when I filed my unemployment. I made a mistake. After I couldn't finish my claim on my phone, I did a remote login to my computer and filed.

There was no intention for fraud, in fact I had to pay a prior claim so the money I would have received wouldn't even go to me. I was ready willing and able to work and three hours or less from either coast for work at a moments notice. What can I do? If I show them that I was out of the country will they automatically take my benefits away? Could I get in trouble in any other way?

I am a hard working citizen. I try my best to get work. The holidays are coming and now I am losing my money. Please help.

This is serious but there may be a way out of this predicament. Go to this link for Q&A from the Dept. of Labor and you may need an attorney to help make the argument - if there is one under a very narrow exception. http://www.labor.ny.gov/ui-appeal/frequently-asked-questions.shtm?direct-link=information-about-ui-hearings|how-to-ask
