Legal Question in Employment Law in New York
Our contract expired June 30th because the company and union have not come to an agreement. The union is telling us we are being locked out while the company is calling it a work stoppage. The company offered to extend our current contract for two weeks while negotiations continue and the union declined but offered to work without a contract while continuing negotiations. The company declined and informed us not to report to work. Would this make the union employees eligible for unemployment under a lock out even though the company offered to extend the previous contract?

File for unemployment. If you are denied, appeal. On the facts you have presented, you should be eligible.
