Legal Question in Employment Law in New York

can I be ''cut'' from work

I work at a restaurant as a waiter. Can I be ''cut'' before the start of my shift if my employers suspect a slow business day? Or am I guaranteed my shift no matter how many guests come in to the restaurant?

Re: can I be ''cut'' from work

Unless you have a contract or are a member of a union, you have no guarantees. You have no "right" to work. You can be cut prior to a shift, or even during the shift, provided you are paid for the time actually worked.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
