Legal Question in Employment Law in New York
Driven out of job
I was working as a General Manager at a company for and was forced to resign because I was given the responsibility of an Operations Manager for that person had quit. I could not handle the stress and got sick because of this additional responsibility, but never called in sick. I had asked for help and the company provided me with a bit of training that was never uninterepted. I was never given full training that would assist me in doing the job,and although I was not hired as the operations manager. They also altered my job description to indicate that as the General Manager, I was now responsible for Operations. I was told that they would hire someone to assist me, but that never happened. Once I resigned, they had a woman to replace me that same day, and also hired a person to do the operations which is what I had been asking for. Do I have a case? x.

Re: Driven out of job
My question is whether you were constructively terminated, so as to entitle you to collect unemployment. Sometimes where an employer imposes vastly unreasonable workload and pressures on an employee, they might be deemed to have been terminated, even though they "resigned."
Generally, however, NY law is very tough for employees. I assume you have no union and no written employment agreement. Employees at will can generally be terminated for any reason or for no reason at all, except if it's within the law's anti-discrimination provisions.
