Legal Question in Employment Law in New York

DWI Termination vs. Ont the job drug use with no termination

I was charged with a DWI after work hours. I am mostlikely facing termination under a zero tolerance policy. After the incident I have asked for help combating alcholism. I am not sure how this is going to work out. I do know however that an employee was tracked on GPS and found to be in a drug area of the city and then failed a drug test immediately after the GPS review and that employee was not terminated and was given a 2nd chance after going to classes and having his company driving previledges revoked for 90 days. Help?

Re: DWI Termination vs. Ont the job drug use with no termination

If driving is a job requirement and you lose your driving privileges through the State then the company can terminate your employment because you are not able to fulfill the requirements of your job.
