Legal Question in Employment Law in New York

Employee health benefits

I have been working at my current employer for 8 months... I was told during my initial interview that I would get benefits after 6 months ( which is awful, but i dealt with it) here I am 8 months later and I am being told that because I called in sick too many times I am not considered full time?

I work in the mortgage industry and I feel that because he is going through a hardship paying us, that I am going to suffer. Can he do this to me? make me work for 6 months expecting insurance and then just NOT give it to me? he doesn't pay for holidays, he doesn't pay for sick time and now he's denying my benefits that i was promised? I want to sue him, not only for this, but for unpaid over time and unpaid bonus as well. these are all things verbally discussed not only at the time of the interview, AND also on the day of me starting, the office manager told me the same thing. Now all of a sudden it's time to give me benefits and they wont. I've been in this business WAY too long and have seen it ALL and still noone has done THIS to me EVER. HELP

Whether or not you are being compensated in accordance with the Fair Labor Standards Act depends on some factors that you did not mention in your question.
