employer drug testing
if someone tests possitive for THC and they smoked marijuana in a country where its legal can an employer place dicsiplinary action?

Yes because the employer has discretion in not allowing drugs or alcohol in the workplace. For example he could discipline for being drunk, even though that is not illegal.
