Legal Question in Employment Law in New York

Employment Law

Can employees of county govt. civil service employees be restricted from wearing pants that are of jean material. Specifically, dark wash with appropriate shoes & shirt /sweater? Not talking about jeans that are faded, with holes or embellished. If so, is there an article of law that applies to that?

Thank You.....Michelle

Re: Employment Law

Probably if the rule is uniform throughout the organization and there is a reason for it. I would imagine that while you have nice jeans, others may have the type you describe and the employer does not want to get involved in a game of "these are faded those are not." It is just easier to ban them totally.

If you work for the government, you are more than likely unionized. Get the CSEA or other union to bargain for it in the contract.

Good Luck.
