Legal Question in Employment Law in New York

Employment law question

I work for a large bank firm in CO. their HQ is in NY. When considering employment rules, are they allowed to enforce NY labor laws or CO laborlaws?

If your job is primarially based in Colorado, then the company is subject to Colorado law. If you have an employment contract which states that the contract will be interpreted with respect to New York law and the protections provided under New York law, an argument can be made, (but probably will not prevail) that your employment is provided under New York law. The reason such a clause would probably not prevail is choice of law clauses are usually enforceable for purposes of interperting a contract but not separate statutory protections that are ancillary to the contract.
