Legal Question in Employment Law in New York

Eoe?

A group of 15 employees worked on a

television show for many years. The

show was cancelled and a new

program was created by the

company. Some of the 15 applied to

work on the new show, but were told

they're not hiring anyone from the

cancelled show.

Is this legal? Can they discriminate

against an entire group of former

employees?

The answer to your question depends on "why" the company did not hire anyone from the old show. In general, an employer is not required to rehire former employees (e.g. the 15 who worked on the earlier show). However, the employer is prohibited from making an employment decision based on age, race, gender, religion, and other irrelevant criteria. I am familiar with the entertainment industry and have seen age discrimination in employment decisions.
