Legal Question in Employment Law in New York

Fighting a denied claim

Unemployement said I quit. I believe I was forced out and have a right to claim benefits. My employer originally told me that she would not fight my claiming for benefits, and now she is. How can I fight this and win at my upcoming hearing?

You must request a hearing from the department of labor, to dispute the denial.

It all depends on what you have to offer as evidence. For example, where you forced to resign in lieu of an involuntary termination may be considered as an involuntary termination. I believe that the best advice is for you to review your situation with an attorney given that you are perhaps risking approximately $10,000 in payments.
