Legal Question in Employment Law in New York

Fired

I was contacted after i had called in sick. My employer said get some rest and we will see you tomorow I was then called at 5pm and told that they have decided that we should part ways and I was let go. I had been with them for 2 years working 10-12 hour days and had moved into a new office etc I had started to loose weight and then was constantly not feeling well. They fired me on the phone and are not allowing me to get my personal affects that they would go through them and mail them to me. they gave me praise and told me that they would give me letters of recommendation. I have since not been mailed my personal items of which they told me were now the property of the company which i know is not the case. They have not provided me with any policy for the company that Ihave asked for over a 4 month period, have not paid for overtime, vacation etc. a day here and there when i needed to see a doctor. I was the highest paid employee and they had someone already hired to replace me. What are my rights in this case.

Re: Fired

Before you sign anything, you should speak with an attorney. There are potentially serious FMLA and FLSA issues here, in addition to breach of contract claims.

My office focuses extensively on employment law, with a particular interest in negotiating severance packages for employees who have been terminated. You may contact my office via email or through SeveranceAttorney.com.
