Legal Question in Employment Law in New York

I was fired after I told my boss I needed a hysterectomy

I worked for a company for 6 weeks, then was told by my doctor that I would need a hysterectomy. I informed my boss of the situation and told him it would not take place for about 6 weeks. Two days later I was terminated for unsatisfactory job performance, although on two occasions prior I was told by my boss I was doing fine. I feel I was discriminated against because of sex and disabilty. Is this a wrongful termination case?

Re: I was fired after I told my boss I needed a hysterectomy

Sounds like discrimination on the basis of sex

to me. There is no such thing as " wrongful

discharge " in New York.

You would have rights under the Federal, State

and Local antidiscrimination laws if your employer is anywhere in the five counties of

New York City. If not, you would have rights under

the first two; Federal and New York State.

See a discrimination lawyer. Make SURE they

are practicing in this field. Ideally they

should be members of NELA, the National Employment

Lawyers Association because if they are , more

than 50% of their practice is in employment law

and of that, better than 95% on behalf of

employees and against employers.
