Legal Question in Employment Law in New York
Can I be Fired?
I was fired yesterday at my place of employment due to the fact that I left because I was sick after having an insulin reaction. I did inform the manager at the time that I was leaving because I was sick he at first said ''okay'' and then as soon as I had punched out informed me that if I left I would be terminated. The general manager decided that he was right and therefore I lost my job. I feel that it is due to a few things. A0I turned the manager who was there when I left in to the general manager for sexual harassment and B0He doesn't think that I could become ill from having a reaction to the point where I need to leave. Can they do this?

Re: Can I be Fired?
It is illegal for them to fire you for having reported sexual harassment-if that's why your manager fired you, what they did is illegal. If you have a disability that requires you to take insulin, your employer cannot fire you because of your disability. So this could be illegal as well. I would want to know more about what happened and your entire work history with the employer, but it sounds like there could be a legal basis for challenging what your employer did. I have worked on cases like this and would be glad to discuss your options with you. You can reach me at 212 867-4754.
