Legal Question in Employment Law in New York

I'm on FMLA my last day at work was 09/10/12. I received a letter stating I need to return on 12/ 03/12 or I would be terminated. I get 12 weeks of FMLA I should return on 12/10/12. If terminated would I have a lawsuit?

The problem may be with your math. 3 months 12 weeks. September has 2 extra days, October has 3 and November has 2. There's your extra week.
