freedom of information act regarding depositions

I was wondering if a deposition for a federal case in an ongoing unlawful termination suit is subject to the freedom of information act. I would like to review the deposition hearing tesitimony but I'm not a party in the lawsuit. The hearing is Oct 7th and I was wondering how I would go about requesting the documents from the testimony and what timeframe I could expect to recieve those documents if it was covered under the FOI act.

The answer is no.

It becomes a public record if it is filed with the court, but until then it is not public, and in fact is probably confidential depending on the nature of the claim.
