harassment in the workplace

i have been working at this job for 8years. In most of those year I have worked in yhe office with two other coworkers . It's very loud and disruptive by one person in the group. WE have taken the problem to the highest management we can. They have tried to work with all of us knowing which person is the problem and nothing has changed. She makes our lives a living hell and no one seems to want to put and end to this problem. Iknow Icould quite! I like the job and benifits so Idon't want to Is there any legeal avenue for me to take? I'm takeing medicine for this tension I'm haveing because of work. Please help I'm getting tired. Thank you for your time.

A loud and disruptive environment in and of itself generally does not create a legal cause of action. However, if the loudness and disruption is of such a nature that it violates a protected status such as race, gender, age, religion or disability, and together it is causing a hostile work environment, then it's possible there is a legal cause of action. Further, if the noise level and disruption rises to such a high level, there may be a viable criminal complaint for disturbing the peace, for which you may be able to contact the police. Otherwise, to deal with a disruptive employee, your best bet is to bring this to your boss' attention, explain that you would like to stay at this company and explain how this person is disrupting your productivity and ability to work. If your boss is smart, he/she should do something about it.
