Legal Question in Employment Law in New York

health premiums not paid by employer

My husbands former employer did not pay the health insurance premiums for 15 days. Between 1/31/00 and 2/15/00 we had no health insurance without our knowledge.I had to pay a $350.00 prescription bill for my medication. The ex- employer will not take my phone calls. He will not pay this bill. The insurance company says he could not do this, that it is illegal.I would like to know if I can file in small claims court, and would it be worth it?

Re: health premiums not paid by employer

There is a federal law called COBRA, which places restrictions on employer's right to terminate health insurance coverage without affording employee certain notices. I'm not conversant enough to give you the specifics, unfortunately. Maybe somebody else knows. Or look for an attorney who advertises as handling labor or health law matters.
