Legal Question in Employment Law in New York

Hello,

I work for NBC/UNIVERSAL.

I have a problem with my employer not paying me when I am suppose to be.

I have child support deducted directly from my paycheck each week.

When I don�t get paid child support is not sent to Albany.

This has happened at least 7 or 8 times this year.

The last time it happened I was put on the deadbeat list and the letter they sent me stated that if they don�t get paid they would revoke my license and or confiscate my tax return.

Well today they did not pay me again and I don�t know what to do about the child support.

Please let me know what to do.

Get the documentation from the child support services where the money is alleged to be going. When your wages are garnished your employer must provide to you a copy of the garnishment and garnishee information. Once you have proof of the amounts, or lack of amounts paid, use your pay records for the past year, and go show the child support company that your wages were withheld but not paid. This is a criminal act!!!! The employer is required to give you detailed information each and every pay day for how the money you earned was disbursed. You could go to the Labor Board for the employer's failure to pay you and/or the garnishee, and you could file a claim of theft with the police if you have the documentation showing the withholdings and the failure of the employer to pay the garnishee. Be tough on the employer . . this is a huge violation. Protect your rights.
