Legal Question in Employment Law in New York
I was hired 13 years ago as a Schedule A appoinment in a federal building with minimum security level. his type of appoinmnet is for legal, non citizens. I also had been convicted of a a felony. I never lied on my application 13 years ago and since that time have gone through 4 back ground checks and fingerprinting and again was always truthful.Since my employment began I have recieved employee of the year, unsung hero, and each and every year I get a performance award for excellent service.
This past week I had to go through yet another background check. My question is, if I were to lose my employment due to my past record and status do I have any legal rights to fight such a decision? I feel that after all these years it would be horrible to be terminated. Thank you

Yes . . . and this is a qualified answer . . . most lower ranking federal employees have the right to a due process hearing in most circumstances. If such should occur, meaning a notice of pending termination, you will need to hire an attorney or you can elect to have a union attorney if such is available.
