Legal Question in Employment Law in New York
Home attendant investigation
My mother is a home attendant and she takes care of people in their home. Two days ago her patient wanted to take a shower and accidentally burned himself and was taken to the hospital. My mother's boss asked her what happened and she said she was in the bathroom too helping him. In the hospital however in the confusion, the patient got confused and said that she was not. Now he says he was wrong and that she was indeed in th bathroom. Today my mother went into the office and was made to sign a paper that stated that she was in the bathroom with him. She was told there was going to be an investigation by the city of New York. My question is what can happen to my mother, what are the chances she will be fired? is it a possibility that her home attendant's license can be revoked? If so would it be possible to get it back by way to going through the schooling again? Thank you very much for your help.

Re: Home attendant investigation
If she was in the bathroom, and the patient backs her up, the likelihood of anything happening to your mother is remote. If she was in the bathroom, there is no downside in signing a paper saying she was doing what she was supposed to.
