Legal Question in Employment Law in New York

humiliation while firing

i was fired. my boss fired me in front of others, said i was a ''loose cannon'' and that i was ''out of my mind''. she had never given me any prevoius warnings or disciplinary actions, although others in the office have received warnings whenever they did something wrong... it seems as though she singled me out.i worked there for a year & 1/2. can i recover anything due to her humiliating me w/ untrue statements in front of others, or any other reason.this type of action was not the norm around this office-completely out of left field.

Re: humiliation while firing

In New York, a bastion of employment at will, the humiliation is free. No charge. Nada. As far as sueing her for it personally, forget about it. Even though the incident is traumatic, the standard for compensable trauma in New York is so high that a Hiroshima or Auschwitz survivor has a 50-50 chance of meeting it.

Don't prove her right. Tighten up your cannon and get another job. And be sure to apply for Unemployment Insurance IMMEDIATELY and to take an appeal if denied. It costs you nothing.
