Legal Question in Employment Law in New York
My husband received a buyout package from the financially troubled university he has worked for for over 10 years...He will be 69 in December and had no plans to retire...If he doesn't take the package and is subsequently fired for no reason, do we have grounds for a lawsuit??

Whether your husband will have a lawsiut will depend on whether he can establish a claim.
If your husband is discharged as a result of his age or some other civil rights claim, then he can sue.
Has your husband experienced any discrimination based on his age?

Sincerely,
If the company is forcing him out and denying him retirement benefits that he may have otherwise been entitled to, he may have several grounds on which to sue his employer. In any event, you should speak with an attorney whose practice focuses on severance law and termination. You can reach me at [email protected] for a free telephone consultation.
Good luck!
