Legal Question in Employment Law in New York

International labor law - Canada

My company has a Canadian employee working in Quebec who may have the right to be paid for all unused vacation days when she leaves the company, according to Quebec law. However, all American employees do not have this right. So what takes precedence, Quebec/Canada law regarding vacation days, or an American company's handbook that states unused vacation days will not be paid out? Thank you.

If the employee is based in Quebec, and working for the company in Quebec, the company is subject to Quebec law in that Province for the same reason that foreign companies operating in the U.S. must operate under American law for their offices or factories present within the U.S.
