Legal Question in Employment Law in New York
''Latinos getting fired by illness'' a company trend
In August 2006, a latina female Customer Service Supervisor co-worker called in sick, after lifting heavy mail boxes at work.
She was discharged while on sick leave.
I am a latino man and Network Engineer. In late october 2006, I had a hernia repair surgery. I cannot lift anything heavier than a telephone directory for 8 weeks after surgery.
I was discharged without reasonable cause in the middle of November.
Do we have grounds here for a lawsuit for race discrimination, sickness discrimination, wrongful termination or any combination of the 3?

Maybe, if the reason for the termination of employment for both you and the other Latina supervisor was your race, color or national origin then you may pursue claims against the company.
