Lay-off or terminated

My brother was laid off this month, his boss told him it was suppose to happen 6 months ago. The reason he was being laid off was because the department does not need a supervisor, two weeks later they promoted one of the workers in the department to supervisor. Is this being laid off or is there another reason why he was let go but was not told? Can they do this?

It probably is legal but I would need more information to know for sure. Did your brother have a contract? Was the firing retaliatory? Did he have a disability? Was he being discriminated against? I would be happy to talk to your brother to evaluate his claim.
