Legal Question in Employment Law in New York
Is it legal for my employer to delay my paycheck?
My company is merging with another, larger company. I will soon be an employee of the larger company. Myself and others were handed an inch thick set of paperwork (Employee forms, w-4, health insurance, life insurance, etc)and told to fill it out with no guidance or instruction. I was out of work the day they were going to have a "meeting" regarding the paperwork. I received a call from a fellow employee who was told if the paperwork wasn't handed in on that day they would be withholding paychecks. I was never informed of this by HR or management. I was not given an opportunity to have my questions answered regarding the forms. Did I forgo my right to information by not being at work on the day they had the "meeting"?
This whole situation transpired over 3 days (Wednesday to Friday). I was handed the paperwork late Wednesday. Thursday there was rumor the meeting would take place on Friday. We never received any notification regarding a meeting would be held to answer questions! However, Friday was the day I was out of town.
