Legal Question in Employment Law in New York
Is this All Legal In Ny?
Im desperate for a answer I work for a theme restaurant in NY
hired and filled employment application which i believe is a legal contract, hired for 37 hrs and no holidays
2-After 6 months im lucky if i get 30 hrs a week if its slow there I get cut and sent home early losing hours.
im told its mandatory to work holidays while others have been given off. and u dont get extra pay for them
5-i had a dying neice and was told i had to ignore her and come to work if i wanted my job
6-I only work 11am - 6pm and have a nite job they wont let me come in before 11am because they dont want to pay someone to come in later for break coverage and i go 6 hrs with no break lunch/bathroom and told tough or work 3 hrs get sent to lunch then sent home if they cut u they force u to take break.
i wasnt told vacation based on your hours and fluctuates weekly so u get 20 hrs for feb-oct which u cant use at once other 20 hrs nov1-jan15 which u cant use due to holidays and lose em jan 31
Also theres a person on staff who gets preferential treatment and does no work when i spoke to manager 6 different ones all told me if i keep this up ill be terminated?

If you would like to consult with me, I'd be happy to look at your employment contract and discuss whether you have legitimate grounds to believe your employment application is a contract. Most likely it is not.
Unofortunately, much of what you describe is common in the restaurant business and legal. I would strongly suggest, that if your job isn't meeting your current life-style and financial needs, you start looking for a job in some other sector of the economy.
