Legal Question in Employment Law in New York

Is it legal to require someone to fill out a W-9 before they are hired? I applied for a job online, as an independent contractor, and I had to fill out a W-9 and then take an assesment test. After the assesment I was told that I was not compatible for the position, which is fine, but now they have all my personal info. It occured to me that they could just be building a database and not really hiring anyone at all. Shouldn't they have applicants fill out the W-9 after the assesment, if they are accepted?
