legal responcibility and rights of a bystander

I am forming a show that my be played on television or sold. The show is kind of a canded camera show. I was wondering what I have to do to make the bystander that is in the shot legally be showed on the the video, and to be legaly be showed on tv or sold. I was also wondering if the rule that applies to someone dirrectly in the shot applies to someone who is in the backround.

If you are going to air the video for commercial gain you must secure a release from any person identifiably depicted in the video. Every person must be aware of your intent to air the work and retain the rights to sell or lease the work and they must sign an acknowlegment of this understanding. If the video is embarrassing to any person in any way you should get a waiver for that too.
