Legal Question in Employment Law in New York

Maternity/Short term disability

My company is based in N.Y, they are providing the minimum amount of short term disability- $170.00 a week(minimum of N.Y. law)for me on my maternity leave. I am based in Illinois. Does Illinois law pertain to me or N.Y. law? I also have commision money already earned and due to be payed to me while I am on my leave, can I still collect this commision along with my short term disability pay?

Generally speaking Federal Law governs this area, although the States

each have a Labor Department, laws and rules. If your company is a NY Corporation, they probably follow NY Law and /or Federal Law.

As to your commission monies, I believe the Department of Labor in NY will assist you in collecting that.
