Legal Question in Employment Law in New York

The NYCTA has recently instituted a new Zero Tolerance policy regarding cell phones. We are now not permitted to have a cell phone on our possesion powered on, or in sight, other wise if detected, we will be terminated! Using a phone while driving a motorized vehicle is understandably not acceptable. But, not being allowed to have calls or texts come in to the phone, while not answering or viewing the message until stopped seems a violation of my basic rights, especially in family emergency situations. I myself am the only family member in NY who is taking care of my 89 year old mother. Now, if she needs to reach me or her Life Alert medical company needs to call me, I may not be able to get this message for upwards of over 1 hour? This seems like a matter of basic human rights plus life & death issues that are being descrimated against. Do you think the employees of the NYCTA have a fight?

This sounds like an issue you should take up with your union and let them do the heavy lifting.
