Legal Question in Employment Law in New York

NYS Racial Discrim./Wrongful Term. and Severence Questions

Was laid of spring of 2005 (maybe it's too late) from a famous fashion co in

NYC. Depressed, sent back my signed severance agreement 3 wks late. They

never paid me severance nor answered my requests for updates. I'm not a

union member. They didn't contest my NYSDOL insurance request. I was laid

off due to restructuring, no one else did my duties then and was replaced by

part-time. But I feel I was laid off due to racial discrim. against myself and for

not practicing it in hiring models.

1) Should I give up on getting my severance? Waited so long b/c I didn't want

to come across as difficult, didn't expect these results and was embarrassed.

2) Can I do anything to get some kind of payment? I know they are not even

obligated to provide a severance program.

3) Does their non-compliance mean I can share my knowledge of their

business with anyone w/out legal rebuke? Can they say whatever when my

potential new employers contact them?

4) If I feel that I was let go b/c I wouldn't condone their discrimination in their

practice of hiring minorities, is that grounds for racial discrim/wrongful term.

suit? Do lawsuits go on your record acessible to public? True most are not

won for plantiff? Thanks.

While it is not too late to file suit for discriminatory treatment, a review of the papers you signed is necessary to determine what your rights are.
