Legal Question in Employment Law in New York
I have been overpaid by my employer since 9/18/09. Because I have direct deposit & my boyfirend does all of our finances such as pay all bills.....I never saw the increase. Now my employer wants to collect the entire amount back. Because I work for a school district which is from Sep. thru June, they want to deduct everything between now and June.....which has basically put a hardship on me. I have also already submitted my 2009 taxes...........can they do this???

You must return the overpayment otherwise you may face a termination of employment or criminal sanctions in a worse case scenario. I would suggest that you enter into a repayment schedule with your employer and see a tax expert on filing a corrected tax return.
