Legal Question in Employment Law in New York

Overpayment by employer

I have been seperated from my last

company since the end 10/06 and

last week received a letter in the

mail stating I owed them money due

to an overpayment on thier part. I

left on my own valition and did not

ask for this money. What is the law

regarding my obligation to pay it

back?

Re: Overpayment by employer

It depends on how much. They do have a right to get back money paid in error if they can show that you knew or should have known of the mistake.

Your other option would be (depending on how much money is at stake) to have an attorney negotiate with them to accept a reduced amount in full settlement of their claim.
